These Terms of Service govern your use of the Nova Traders website, products, memberships, customer access areas, Discord community access, and related services. By accessing or using Nova Traders, you agree to these Terms.
1. Eligibility and Acceptance
You must be at least 18 years old and legally able to enter into binding agreements to use Nova Traders services. If you do not agree to these Terms, do not use the site or purchase any products or memberships.
2. Educational and Software Use Only
Nova Traders provides software, tools, indicators, strategies, support resources, and educational materials. Nothing on this site or within any Nova Traders product is financial advice, investment advice, brokerage advice, or a recommendation to buy or sell any security, futures contract, option, or other financial instrument.
3. Trading Risk
Trading futures and other financial markets involves substantial risk and is not suitable for every person. You are solely responsible for your own decisions, trade execution, risk controls, and account outcomes. Past performance is not indicative of future results.
4. Product Access and License
Unless otherwise stated in writing, products sold by Nova Traders are licensed, not sold. Your purchase grants you a limited, revocable, non-exclusive, non-transferable license to use the product for your own lawful internal use, subject to any membership tier, account limits, platform restrictions, and support rules that apply. You may not copy, redistribute, resell, sublicense, publish, reverse engineer, share account access, or otherwise exploit Nova Traders products except as expressly permitted in writing.
5. Memberships and Access Tiers
Membership access, included products, feature availability, support access, and platform benefits may vary by tier. Nova Traders may update membership packaging, included benefits, platform availability, and support structure over time. Changes will not retroactively grant rights beyond the active tier associated with your account.
6. Billing and No-Refund Policy
By purchasing a product or membership, you authorize Nova Traders and its payment processors to charge the applicable fees, taxes, and recurring subscription amounts if you enroll in a recurring plan. All sales are final unless required otherwise by law. Nova Traders does not offer refunds, partial refunds, or prorated refunds for digital products, memberships, support access, Discord access, downloaded content, or unused subscription time. 7. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify Nova Traders promptly if you believe your account has been compromised.
8. Acceptable Use
You agree not to misuse the website, customer access areas, Discord community, downloads, support channels, or any related systems. Abuse, harassment, unauthorized sharing, scraping, circumvention, reverse engineering, credential sharing, or unlawful use may result in suspension or termination without refund.
9. Service Availability
Nova Traders may update, modify, suspend, or discontinue any portion of the site, products, memberships, or support systems at any time. We do not guarantee uninterrupted availability, compatibility with every environment, or error-free operation.
10. Disclaimers
All services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. Nova Traders disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that products will generate profits, reduce losses, or perform without interruption.
11. Limitation of Liability
To the fullest extent permitted by law, Nova Traders and its owners, officers, affiliates, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, trading losses, account losses, business interruption, or system downtime arising out of or related to your use of the services.
12. Indemnification
You agree to indemnify and hold harmless Nova Traders and its affiliates from any claims, liabilities, damages, losses, and expenses arising from your misuse of the services, violation of these Terms, or violation of any law or third-party right.
13. Termination
Nova Traders may suspend or terminate access at any time if you violate these Terms, misuse the platform, or create risk to the business, products, community, or other users.
14. Governing Law
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles.
